These Terms of Service (“Terms”) govern your use of the Lister Health Metrics application (the “App”), which supports Remote Patient Monitoring (RPM), Chronic Care Management (CCM), and Principal Care Management (PCM), provided by Lister Healthcare Corporation (“we,” “us,” “our”). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.
Medical and emergency disclaimer
The App supports monitoring and care management **between** clinical visits. It is **not** a substitute for professional medical judgment, diagnosis, or treatment, and it does **not** provide real-time or 24/7 monitoring. Readings you submit may not be reviewed immediately. **The App is not for medical emergencies. If you are experiencing an emergency or need immediate assistance, call 911 (or your local emergency number) or go to the nearest emergency room. Do not use the App to request urgent or emergency help.**
Description of the service
The App allows enrolled patients to record and transmit health readings to their care team for monitoring, supports ongoing chronic and principal care management and care coordination, and lets patients receive reminders by app notification and, where opted in, text message. Availability depends on enrollment, device compatibility, connectivity, and other factors.
Eligibility and accounts
The App is for patients enrolled in a monitoring or care management program. Account credentials are issued to or created by you. You are responsible for keeping your credentials confidential and for activity under your account. You agree to provide accurate information and to keep it current.
Your responsibilities
– Enter readings and information accurately and use monitoring devices as instructed.
– Follow your care team’s guidance; the App supplements but does not replace that guidance.
– Contact your clinic or emergency services directly for urgent concerns — do not rely on the App to alert anyone.
– Keep your login credentials secure and notify us of any unauthorized use.
Limitations of the App
The App depends on factors outside our control, including your device, network connectivity, and third-party services. We do not guarantee that readings will be transmitted, received, or reviewed within any particular time, or that the service will be uninterrupted or error-free. The App is not a monitored alarm or alert system.
Ownership and acceptable use
The App and its content are owned by Lister Healthcare Corporation and its licensors and are protected by law. We grant you a limited, personal, non-transferable license to use the App for your own monitoring and care management. You agree not to copy, modify, reverse-engineer, resell, or misuse the App, attempt to access data that is not yours, or use the App for any unlawful purpose.
Suspension and termination
We may suspend or terminate access if these Terms are violated, if required for security or legal reasons, or if your enrollment ends. You may stop using the App and delete your account at any time from within the App, subject to legally required record retention.
Disclaimers and limitation of liability
The App is provided “as is” and “as available” without warranties of any kind to the fullest extent permitted by law. To the fullest extent permitted by law, Lister Healthcare Corporation is not liable for indirect, incidental, or consequential damages arising from use of the App. Nothing in these Terms limits liability that cannot be limited under applicable law.
Governing law
These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-laws principles.
Changes to these Terms
We may update these Terms and will post the revised version with a new effective date. Continued use after changes means you accept the updated Terms.
Children
Lister Health Metrics is intended for patients enrolled in monitoring or care management programs and is not directed to children under 13.
